These Terms & Conditions govern your access to and use of the MBMC Pothole Reporting & Repair System mobile application and citizen web portal operated by the Mira Bhayandar Municipal Corporation (MBMC).
1. Acceptance of Terms
By registering, logging in, or using the application, you agree to comply with these Terms & Conditions and all applicable laws and municipal regulations.
2. Eligibility
You must provide accurate registration information and use the application only for lawful reporting of pothole and road-related complaints within the MBMC jurisdiction.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You must promptly notify MBMC if you suspect unauthorized use of your account.
- You must not share your account with others or impersonate another person.
4. Complaint Submission
When submitting a complaint, you agree to:
- Provide truthful, accurate, and complete information.
- Capture complaint location and photographs at or near the actual pothole site.
- Not submit false, misleading, duplicate, abusive, or malicious complaints.
- Allow MBMC staff to review, assign, verify, and act upon submitted complaints.
5. Location and Photo Data
The application may require GPS coordinates and photographs for complaint registration and repair verification. You consent to the collection and use of such data for municipal service delivery, monitoring, and audit purposes.
6. Service Availability
MBMC strives to keep the application available at all times but does not guarantee uninterrupted access. Maintenance, network issues, or technical failures may temporarily affect service availability.
7. Complaint Resolution
Submission of a complaint does not guarantee a fixed resolution timeline. Repair priority may depend on severity, resources, weather, contractor availability, and operational requirements determined by MBMC.
8. Prohibited Conduct
You must not:
- Attempt to hack, disrupt, reverse engineer, or misuse the application.
- Upload offensive, unlawful, or unrelated content.
- Use automated tools to flood the system with requests or complaints.
- Interfere with officers, engineers, or other users of the platform.
9. Intellectual Property
The application, its design, software, logos, and content are owned by or licensed to MBMC. You may not copy, modify, distribute, or exploit any part of the service without prior written permission.
10. Limitation of Liability
To the fullest extent permitted by law, MBMC shall not be liable for indirect, incidental, or consequential damages arising from use of the application, including delays in complaint resolution, data loss, or temporary service interruption.
11. Suspension and Termination
MBMC may suspend or terminate access to the application if these terms are violated, fraudulent activity is detected, or continued access is deemed necessary to protect public interest or system integrity.
12. Governing Law
These Terms & Conditions are governed by the laws of India. Courts having jurisdiction in Maharashtra shall have exclusive jurisdiction over disputes relating to the use of this application, subject to applicable municipal and statutory provisions.
13. Changes to Terms
MBMC may revise these Terms & Conditions at any time. Updated terms will be published in the application. Continued use after publication constitutes acceptance of the revised terms.
